Abortion *Wildcard* - Mental Health Grounds
Section 13 of the Act allows for abortion without a reason up to 12 weeks of pregnancy
A termination of pregnancy may be carried out in accordance with this section by a medical practitioner where, having examined the pregnant woman, he or she is of the reasonable opinion formed in good faith that the pregnancy concerned has not exceeded 12 weeks of pregnancy.
Section 10 of the Act goes even further . It introduces abortion on grounds of mental health up to 'viability'
A termination of pregnancy may be carried out in accordance with this section where 2 medical practitioners, having examined the pregnant woman, are of the reasonable opinion formed in good faith that—
(a) there is a risk to the life, or of serious harm to the health* of the pregnant woman
(b) the foetus has not reached "viability"
*Definitions (section 9)
"health” means physical or mental health;
"viability” means the point in a pregnancy at which, in the reasonable opinion of amedical practitioner, the foetus is capable of survival outside the uterus without extraordinary life-sustaining measures
In England and Wales , 97.5% of all abortions in 2017 were done on mental health grounds . Ground C abortions they are called . (source department of health national statistics ) . In total 185,448 were performed under ground C (risk to health) . 99.5% were mental health cases.
Under the UK's 1967 Abortion Act , the consent of two doctors is also required for abortion on mental health grounds. However , in 2008 , Ann Marie Furedi , the chief executive of BPAS, the UK's largest abortion provider said .." we all know if we are honest that Ground C is a kind of code for its an unwanted pregnancy .. women pretend they'll have a nervous breakdown if they continue with their pregnancy and doctors have to pretend to believe them " - Ann Marie Furedi BPAS .
If Ireland follows the same path which the proposed legislation allows for and in many respects we tend to follow UK trends on various social matters , late term abortions up to viability will soon be common place under the pretence of mental health just like it is in the UK .
