Convicted terrorist could return to Ireland after prison term is completed

Jihadist Ali Charaf Damache

In February , the Supreme Court ruled it would be unlawful for the state to revoke the citizenship of a convicted terrorist if he could not appeal that decision to an independent appeals body . 

In July 2018 , Ali Charaf Damache pleaded guilty in a Philadelphia court to a charge that while living in Ireland he materially assisted in an islamist terrorist conspiracy , he was sentenced to 15 years with a condition that he return to Ireland or Algeria after his sentence is complete. 

Algerian born Ali Charaf Damache arrived in Dublin Airport in the year 2000 and made an application for asylum . His application for asylum was refused , he appealed that decision to the refugee appeals tribunal  , his appeal was refused and on 3rd December 2002 he received written confirmation that his application for asylum in Ireland was refused . A few days later on the 12th December 2002, he married an Irish citizen by birth. He applied for Irish citizenship in July 2006 on the basis of his marriage and became naturalised as an Irish citizen . 

On 8th March 2010 he was arrested by Gardai in Waterford City over a suspected islamic terrorism plot to murder Lars Vilks, a swedish cartoonist whose drawings depicted the islamic prophet Mohammed with the body of a dog . 

On 2nd December, 2010, he sought judicial review to stop his trial on the basis that the evidence obtained on foot of the search warrant was unconstitutionally obtained . This was dismissed by the High Court in 2011 . He appealed that decision to the Supreme Court which ruled in his favour in 2012 .

In the meantime , a United States judge in Pennsylvania had issued a warrant for his arrest over an allegation that he had conspired to create a terrorist cell in Europe, and participated in the attempted theft of U.S.identity documents that were used by a co-conspirator in Pakistan .   

In January 2013 , the state received a request from US authorities seeking his extradition to the US and in February 2013 the High Court issued an extradition warrant for his arrest . Over the following years , Damache began a series of legal challenges against the state aimed at preventing his extradition on the basis that the state did not prosecute him in Ireland for the offences sought in the extradition warrant. His legal challenge was upheld in the courts . 
 

However , in the meantime , he had travelled to Barcelona where he was promptly arrested by the spanish authorities on foot of the extradition warrant issued by the United States and sent to the US in July 2017 where he was convicted on terrorism charges.

In 2018, the Department of Justice and Equality notified Damache that they intended to revoke his irish citizenship on the grounds that he had failed in his duty of loyalty to the nation and fidelity to the state having pleaded guilty to a terrorist offence. 
 
 
In January 2019 , Damache
 supported by the Irish Human rights and Equality Commission (IHREC) filed legal proceedings in the High Court against the Department of Justice on the grounds that the legislation used to revoke his citzenship (section 19 of the Irish Nationality and Citizenship Act 1956) was contrary to the Constitution and EU law including the EU Charter on Fundamental Rights . 

His appeal was rejected by the High Court , he appealed this decision to the Supreme Court backed by the Irish Human Rights and Equality Commission where in February of this year he was successful with the Supreme Court ruling that it would be unlawful for the state to revoke his citizenship if he could not appeal that decision to an independent appeals body .

All in all , terrorist Ali Charaf Damache , spent almost a decade challenging the state in the courts . During this period he took five court cases against the director of prosecutions over warrants and various issues (2011 high court , 2012 supreme court, 2014 court of appeal & high court , 2018 high court again) , he took three court cases against the Minister for Justice over revoking his citizenship (2019 high court , 2020 & 2021 supreme court) , he took 3 cases against the Governor of Cork Prison (2010 , 2011 , 2012) and a case against the Governor of Cloverhill Prison in 2012 . 

In the words of High Court Judge Richard Humphreys who examined one of the cases - ..
 
the applicant has already left something of a trace on jurisprudence in that he has been involved in eleven sets of proceedings in this jurisdiction alone, leaving aside proceedings in Spain and the U.S. He has instituted nine of those sets of proceedings mainly judicial reviews . He has been before every ordinary court in the land at all five levels and has been responsible for seven written judgments already, this being the eighth. The number of different judges of the Superior Courts he has been before is well into double figures
