Irish MEPS vote against Hungary
The Motion was brought to parliament following a report by Dutch MEP Judith Sargentini into Hungary and Prime Minister Viktor Orban's Fidesz party which accuses Hungary of various breaches of EU values mostly refusing to accept migrant Quotas under the Migrant Relocation Scheme .
Article 7 of the Treaty on European Union establishes a process for imposing sanctions on member states that dont comply with 'EU values' .
It reads as follows :
1. On a reasoned proposal by one third of the Member States, by the European Parliament or by the European Commission, the Council, acting by a majority of four fifths of its members after obtaining the consent of the European Parliament, may determine that there is a clear risk of a serious breach by a Member State of the values referred to in Article 2. Before making such a determination, the Council shall hear the Member State in question and, acting in accordance with the same procedure, may address recommendations to it, acting in accordance with the same procedure.The Council shall regularly verify that the grounds on which such a determination was made continue to apply.
2. The European Council, acting by unanimity on a proposal by one third of the Member States or by the Commission and after obtaining the consent of the European Parliament, may determine the existence of a serious and persistent breach by a Member State of the values referred to in Article 2, after inviting the Member State in question to submit its observations
3. Where a determination under paragraph 2 has been made, the Council, acting by a qualified majority, may decide to suspend certain of the rights deriving from the application of the Treaties to the Member State in question,including the voting rights of the representative of the government of that Member State in the Council. In doing so, the Council shall take into account the possible consequences of such a suspension on the rights and obligations of natural and legal persons. The obligations of the Member State in question under the Treaties shall in any case continue to be binding on that State.
Article 7 - Treaty on European Union
Of those MEPs supporting the Motion was 9 of the 11 Irish MEPs , with 2 not voting .
MEPs from Britains Conservative Party supported Hungary and voted against the Motion .
During a debate over the motion on Tuesday, the Hungarian Prime Minister Viktor Orban remained defiant telling lawmakers he would not bow to EU blackmail :
You think that you know the needs of the Hungarian people better than the Hungarian people themselves. Therefore I must say to you that this report does not show respect for the Hungarian people. This report applies double standards, it is an abuse of power, it oversteps the limits on spheres of competence, and the method of its adoption is a treaty violation . Hungary shall continue to defend its borders, stop illegal immigration and defend its rights – against you, too, if necessary

This is the second time in the past year that Article 7 proceedings have been taken against a member state . Last December, the EU Commission triggered Article 7 in relation to Polish Judicial reforms .
Hungary has vowed to appeal any decision to the European Court of Justice .
