Letters : Nursing Homes denying residents access to family over Vax Certs are breaching guidelines


Are you being refused access to your Nursing Home relative over your Vaccination status . If so , you are not alone and in a similar position to myself and others ... and believe it or not , such a refusal is a breach of the HSE Guidelines in relation to exemptions on Vaccine Certs . 

The HSE Guidelines issued to Nursing Homes in November  - "COVID-19: Normalising Visiting in Long Term Residential Care Facilities (LTRCFs) " contain a list of exemptions in Appendix 1 and not only do these exemptions give Nursing Home Staff discretion around Covid Cert requirements but they specificly state that a resident who expresses a strong sense of need to see a visitor should not be denied access to that visitor on the basis that the visitor does not have a Vaccine Cert . 

Exemption 6  ... "A resident expresses a strong sense of need to see someone whether for personal reasons

 Exemption 8 ... "Other circumstances in which the judgement of the medical or nursing staff, registered health or social care professional, spiritual advisor or advocate acting for that the resident is that a visit is important for the person’s health or sense of wellbeing "

COVID-19: Normalising Visiting in Long Term Residential Care Facilities (LTRCFs)
  
 The Guidelines also acknowledge that ...  "the vaccination programme has changed the balance of risk between harm related to restriction of visiting and harm related to COVID-19"  ... "most residents are fully vaccinated against COVID-19 and booster doses have been offered to most residents" and talks about the importance of visitation for residents wellbeing stating that denying residents visitors is "a cause of harm" in itself "to residents , their friends and family" and says that residents must be involved in the decision making around visitation policy

 Restrictions on visiting and the loss of “meaningful contact” are of themselves a cause of harm to residents, their friends and families. Any lack of clarity regarding visiting arrangements and the reasons why they are required can exacerbate this stress and is avoidable. It is essential that the service providers engage with residents, involve them in decision making and communicate clearly with each resident and relevant others regarding visiting policy, including any restrictions
  
 
Unfortunately , Many Nursing Homes have not implemented the Guidelines in full , many are not implementing a system that deals with visitation on compassionate grounds and are not including the residents in the decision making process .

For example , On Saturday , I visited my Aunt in a Nursing Home in Saggart , Co Dublin . I had phoned my Aunt the previous Night to inform her I would be visiting her and she was fully aware I didn't get the vaccine but still wanted to see me .

On arrival , I was asked to fill out a Covid-19 Form at reception which asks a number of questions including your Vaccination status . I answered the form honestly , handed it to the receptionist and proceeded directly to my Aunts room . .

An hour into the visit , two people called to my Aunts room and told me I couldn't be there because I dont have the Vaccine . My Aunt was insisting that I stay . I had the Guidelines on my phone and showed it to one of the staff where it says that .. "the right of a resident to see someone they wish to see is central to the application of exemptions" . I asked to speak to the manager and said I wouldn't be leaving . They went off and came back with an Antigen test which I took for some peace , it came back negative and they went off happy . As I left the Nursing Home , I was told by a staff member that the manager told them to tell me I wouldn't be allowed back in again without a Vaccine Cert or Antigen test , which is contrary to the guidelines as there is no mention of Antigen testing at all in the HSE guidelines and in terms of vaccine certs , regard must be had for exemptions on compassionate grounds .
 

In conclusion , I would urge Nursing Homes to fully implement the exemptions section of the HSE Guidelines in relation to vaccine certs and not to deny anybody access to their loved ones this Christmas or at any time of the year and to work with residents and their families to ensure visitation rights .
