New Planning Exemptions allow State to bypass planning system for Asylum Seeker Centres
Dolcain House Clondalkin. New Planning regulations will allow the state to use a range of buildings without planning permission for asylum seekers
The Planning and Development (Exempted Development No. 4) Regulations 2022 passed through the Houses of the Oireachtas Last Week.

The new Planning Regulations give Minister Roderic O'Gorman the authority to use a wide list of Buildings including Office Blocks to accommodate asylum seekers arriving in Ireland without the need to apply for planning permission.

The new regulations come amid an investigation by planning officials at South Dublin County Council into the state's illegal use of an office block known as Dolcain House in Clondalkin County Dublin which was converted to residential use by the State in September without planning permission or compliance with building control regulations.

While the new regulations exempt the state from the requirement to obtain planning permission, the state will still be obliged to comply with building control regulations in relation to issues such as Fire Safety.

The move comes amid a surge in people claiming asylum in Ireland . Since January alone, some 12,300  Asylum Seekers have arrived in Ireland from Countries around the World in addition to 63,000 Ukrainians who have also arrived under a separate system.

Under EU law (the EU Recast Reception Conditions Directive of 2013) Ireland is legally required to accommode people claiming asylum in Ireland until their claims have been processed which can take a number of years .   

  
Welcoming the new Planning regulations , Fine Gael Senator John Cummins said.. "I thank the Minister of State for introducing these regulations which seek to put temporary change of use in place to accommodate those seeking international protection", comments echoed by Sinn Fein Senator Fintan Warfield who said .. "I welcome the Minister of State back to the House and thank him for brining forward these regulations which we will not oppose" , while Fianna Fail Senator Mary Fitzpatrick  said "I thank him for bringing these regulations to the Seanad. The Fianna Fรกil group will support this emergency measure".

The new planning regulations will stay in force until December 2024.

my response to this is - One Law for All. if the public need planning permission for these things then so should the state. the state should not be above the law.

I mean why should the state's need for something be more important than anyone elses ?????? Most people who apply for planning permission have the same urgent need for it, yet they have to go through the process but the state will be able to skip it. its not right.
A wake up call, facts from govt.or factcheck is controlled.Get a life and ass into gear.

not one media outlet dared to report that the state openly broke the law in clondalkin. too busy name calling and labelling their own customers far-right etc
Ireland,just like USA is controlled by Emergency Executive Orders initiated by Vardecur and Trump in 2020.Thats the downfall.
I witnessed Clondalkins 1st- became 2nd,quickly 3rd and now 4th illegal refuse center compared to 0 in Lieo's stronghold.
Govt. or Councils will not take each other to court...forgone conclusion, so for a handful of greedy developers they and govt/Council
have destroyed a cultural heritage village while the Community sat idly by.
The Court system also favors govt,but at least if community members challenged in court,it is documented and open to appeal.
So if Clondalkin rises to 6-7-8-9 refuge centers,we can all trace it back to the first...how long ago,I know because I complained then.
